The elements of First, Second, Third, and Fourth Degree Criminal Sexual Conduct relating to someone who is in a “position of authority” were designed to prevent harm to individuals of a certain age or a certain vulnerability from actors with knowledge of the vulnerability or actors that occupy “positions of authority” or supervision over the individuals.
